Using an agent
An agent is often a law firm or a patent agency specialized in, for example, trademarks and can be paid to help you with an application. There are two main powers of attorney which are relevant if you want to register a trademark using an agent: a power of attorney and a general power of attorney. Legal persons, firms and natural persons can all act as agents.
Power of attorney
PRV does not currently require that you file a power of attorney with a new application. If you choose to do so, for whatever reason, the power of attorney for the agent must be submitted in the original with the application. The power of attorney must give the agent the right to represent you in matters relating to the registration of a trademark. If you also want the agent to represent you after the registration, that must be stated in the power of attorney. You can even limit it so that it only applies for the actual application. If you live abroad, the power of attorney must give the agent authorization to receive the service of a summons, notices and other documents in proceedings and matters regarding a trademark, with the exception of a summons in a criminal case and of a notice for a party to appear personally in court. If you do not appoint a service agent in Sweden, PRV can use a simplified form of service, which means that documents are sent to the address stated by you and service is then considered to have taken place.
General power of attorney
If you own several trademarks and want to hire the same agent for all of them, you or your agent can request a general power of attorney registered with us. Your agent can then refer to the general power of attorney in future cases. This power of attorney must give the agent the right to speak and answer for you in all matters relating to your or your company's trademarks. In it, you do not need to specify which trademarks the power of attorney covers.
