Change of applicant or owner

If a patent application or patent has been assigned to a new applicant or owner, for example after a sale, you can request that the change is entered in the patent application diary or the patent register.

The request for a change in the patent application diary or the patent register of the applicant or owner should include:

  1. the request to change the details of the applicant/owner
  2. the number of the patent application/patent which the change concerns
  3. the previous applicant's/owner's name
  4. the new applicant's/owner's name and address
  5. the date of the transfer of rights
  6. the basis for the new applicant's/owner's right to the invention/patent application/patent

The request must be signed by the previous or new applicant/owner, or their authorized agent.

New applicant or owner after assignment

A document proving assignment must only be submitted if PRV has special reason to question the information provided in a case. Otherwise, it is enough to state the basis for the new applicant's or owner's right to the application or patent, for example, a purchase or gift.

If assignment needs to be proved, that can be done, for example, using an original certified copy of the agreement or the assignment confirmation signed by the assigner.

New applicant or owner after merger, restructuring or division

If the transfer of rights is based on a merger, restructuring or division of companies, the change must be proved using an original certified copy of a document issued by an authorized authority, such as an extract from a trading company register.

New applicant or owner on another legal basis than agreement, merger or division

If the transfer of rights is based on something other than agreement, restructuring or division of a legal person – for example, application of the law or a court ruling – an original certified copy of a document proving the transfer of rights must be attached.

In the event of the applicant's death, the estate representative must be proved, preferably through an estate inventory.

Change of the applicant's or owner's name or company

If you have changed name or your company has changed trade name, you can request that PRV registers the new name in the patent application diary or the patent register. If you do not request a change of name, post that is sent to you or your company may not arrive.

The request for a change in the patent application diary or the patent register of the applicant's or owner's name or company should include:

  1. the request to register a change of the applicant's/owner's name or company
  2. the number of the patent application/patent which the change concerns
  3. the applicant's/owner's previous name/company
  4. the applicant's/owner's new name/company and address
  5. the date of the change

The request must be signed by the applicant or the owner.

The change of company must be proved using an original certified copy of a document issued by an authorized authority, for example, an extract from a trade or company register.

Translation

If the document proving the transfer of rights is not written in Swedish, Norwegian, Danish or English, PRV can request that the person requesting the change gets the document translated into Swedish.
