Objection

Anyone can submit an objection to someone else's invention during the handling process.

When we assess a patent application, we take into account everything that has been raised during its handling. Anyone can submit an objection to someone else's invention during the handling process. It should be submitted to PRV in writing, entitled “Objection”. If we decide that the objection is significant for the continued handling of the case, we will send it to you as the patent applicant and you will have the opportunity to comment.

An objection cannot be solely based on the invention not being new on the filing date because it was practised publicly. Such a case can only be examined by PRV if it is presented in an opposition.
